加拿大EE移民申請如何確定NOC代碼

加拿大政府根據(jù)本國國情、市場需求、發(fā)展規(guī)劃，每年都會計(jì)劃招收世界各國的優(yōu)秀人才，來彌補(bǔ)本國的勞力缺口和其他領(lǐng)域內(nèi)的不足。基于此，加拿大政府推出技術(shù)移民快速通道，讓更多優(yōu)秀的人才可以快速的登陸加拿大。

根據(jù)Service Canada的網(wǎng)站，國家職業(yè)分類（NOC）是加拿大通用的最權(quán)威的職業(yè)分類體系。在NOC體系下，加拿大幾乎所有的職業(yè)都可以按照主要工作職責(zé)來歸類。加拿大的每一種職業(yè)都有一個4位數(shù)的NOC代碼。

如何確定我的NOC代碼？

確定一個職位的NOC代碼的方式是進(jìn)入Service Canada網(wǎng)站，輸入具體job title或相關(guān)關(guān)鍵字，看哪個NOC代碼最適用。

比如，在網(wǎng)站檢索欄輸入cook，會出現(xiàn)下列和cook相關(guān)的職業(yè)代碼：

NOC代碼如何分類？

對于大多數(shù)移民項(xiàng)目，NOC系統(tǒng)中最重要的信息是"高技術(shù)"和"低技術(shù)"職位之間的區(qū)別。

在NOC制度下，職業(yè)被分為以下技能等級：

0：管理類，以0開頭的職業(yè)是0類職業(yè)，該規(guī)則優(yōu)先于后面的用第二位數(shù)字判斷分類。

A：專業(yè)類，4位職業(yè)代碼第二位是0或1。

B：高技術(shù)類，4位職業(yè)代碼第二位是2或3。

C：（半）低技術(shù)類，4位職業(yè)代碼第二位是4或5。

D：低技術(shù)類，4位職業(yè)代碼第二位是6或7。

0AB職位屬于高技術(shù)類職位，CD類職位屬于低技術(shù)類職位。

兩個相近職位間的差別可以非常細(xì)微，很多時候難以區(qū)分。比如：

NOC 6221–Technical Sales Specialist(Wholesale Trade)包含的職位包括electronic sales representative和farm machinery salesperson，這兩個職位是高技術(shù)職位。加拿大EE移民

NOC 6411–Sales and Account Representatives(Wholesale Trade)–Non-Technical,meanwhile,包含advertising agency broker和freight-forwarder，這兩個職位是低技術(shù)類。

NOC 6221屬于0AB類工作，工作經(jīng)驗(yàn)可以用來申請EE-CEC和FSW,NOC 6411的工作經(jīng)驗(yàn)就不行。

NOC 1241–Administrative Assistants是B類職位，工作經(jīng)驗(yàn)可以用于申請EE移民，而NOC 1411–General office support workers是不符合EE移民要求的C類職位，它們的職責(zé)描述就十分相近：

一個人的職責(zé)可能適用于多個NOC代碼。比如，經(jīng)常有申請人說他們有NOC 1241的工作經(jīng)驗(yàn)，遞交了EE移民申請，但移民局卻判定他們的工作職責(zé)其實(shí)屬于NOC 1411。結(jié)果就是移民局認(rèn)為他們工作經(jīng)驗(yàn)不屬于0AB高技術(shù)類別工作經(jīng)驗(yàn)，他們因而不符合EE移民申請條件。

零售銷售or批發(fā)技術(shù)銷售？

兩個非常容易引起混淆的NOC代碼是NOC 6221-Technical Sales Specialist技術(shù)銷售人員和NOC 6421-Retail Salesperson零售銷售人員。在Saatchi v.Canada(Citizenship and Immigration),2018 FC 1037一案中，法官說：

In reviewing the lead statements for Retail Salesperson(NOC 6421)and Technical Sales Specialist(NOC 6221),there are several important differences,one of which is that the former sells directly to consumers,whereas the latter sells to“governments and to commercial and industrial establishments in domestic and international localities.”Another way this could be explained is a difference in scale.The Technical Sales Specialist sells technical goods and services to institutional clients whereas a Retail Salesperson may typically sell a specific good or service to an individual customer.

As is made clear from the 2016 NOC,Retail Salespersons are explicitly excluded from the ambit of Technical Sales Specialist.An officer assessing NOC 6421 would therefore have an obligation to ensure that an applicant’s experience was truly that of a Technical Sales Specialist and not that of a Retail Salesperson,and hence,excluded.

The onus was on Mr.Saatchi to satisfy the Officer that he met the requirements of Technical Sales Specialist–NOC 6221.In support of his application,Mr.Saatchi submitted two employment letters.While it is true that both letters stated that his job title was Technical Sales Representative–Wholesale Trade Specialist in Heavy-Duty Trucks and Cargo Vans,his employers appeared to be car dealerships.Further,none of the duties listed in his employment letters provided any particulars regarding Mr.Saatchi’s experience in the wholesale trade of heavy-duty trucks and cargo vans.Mr.Saatchi listed in his CEC application that during his time at Scarborotown he was engaged in“auto sales.”加拿大生活

廚師or餐車服務(wù)生？

另外兩個非常容易引起混淆的NOC代碼是餐車服務(wù)生Food Counter Attendant和廚師Cook。

這兩個職位在官網(wǎng)上的lead statement十分相近：

6322–Cooks

Cooks prepare and cook a wide variety of foods.They are employed in restaurants,hotels,hospitals and other health care institutions,central food commissaries,educational institutions and other establishments.They are also employed aboard ships and at construction and logging campsites.

6711–Food counter attendants,kitchen helpers and related support occupations

Food counter attendants and food preparers prepare,heat and finish cooking simple food items and serve customers at food counters.Kitchen helpers,food service helpers and dishwashers clear tables,clean kitchen areas,wash dishes,and perform various other activities to assist workers who prepare or serve food and beverages.They are employed by restaurants,cafés,hotels,fast food outlets,cafeterias,hospitals and other establishments.

在Kumar v.Canada一案中,申請人在J’s Pizza and Convenience Store從事廚師的工作，法官的判決是，申請人的職位并不是廚師，申請人并不準(zhǔn)備各種各樣的食物，只準(zhǔn)備種類有限的簡單食物，如比薩、雞翅、千層餅、沙拉和面包，這些食物是在食品柜臺提供的。

聯(lián)邦EE

聯(lián)邦EE項(xiàng)目是一個非常公平的申請機(jī)制，申請人首先需要對自身?xiàng)l件進(jìn)行打分，打分通過67分的基本要求后，才有資格進(jìn)入EE侯選池等待移民局的邀請。移民邀請根據(jù)入池時CRS分?jǐn)?shù)的高低擇優(yōu)發(fā)送，聯(lián)邦EE項(xiàng)目的審批工作都是由聯(lián)邦政府獨(dú)立完成的。

省提名EE

加拿大各省和地區(qū)會根據(jù)本省的經(jīng)濟(jì)和發(fā)展需求等來制定移民政策，以此促進(jìn)本省經(jīng)濟(jì)的不斷增長。省提名EE就是聯(lián)邦EE池內(nèi)的申請人向目的移民省份進(jìn)行申請省提名。省提名由各省獨(dú)立審理，審理的速度更快。省提名通過之后，再由聯(lián)邦政府審核申請人的健康和品行。
